Road Bear Rental Terms for travel between 01-Nov-2008 and 31-Oct-2009
One-way trips
Upon availability one-way trips are possible between all stations for a one-way fee as specified.
Minimum rentals
3 days minimum rental time (7 nights for Super Deal Rate Codes (SDRC) & one- way rentals)
Payments
A non-refundable booking deposit equivalent to approx 25% of the total rental charges is due upon confirmation. The balance must be received 35 days prior to departure. If payments are not received when due, ROAD BEAR RV reserves the right to cancel the reservation. Without full payment no vehicle will be handed to the customer; no exceptions made! Bank service charges are the customer's responsibility.
Deposit
US$1000.00 which is authorized/blocked on credit card while traveling.
Additional deposits may be required for special events such as "Burning Man", etc.
Credit Cards
VISA, Master/Euro-, American Express cards are accepted.
Refund for unused portion
No refund on confirmed contract will be given if rental is returned prior to scheduled date, unused mileage or for "no shows."
Cancellation
The initial deposit paid is non-refundable. In addition to forfeiting your deposit, the following charges also apply:
Every cancellation needs to be made in writing. The day of receipt of the cancellation is the date the cancellation fee is calculated from
63 calendar days or more prior to departure: Booking Deposit
62 to 33 calendar days prior to rental date: 25% of the daily rental charge plus one-way fee if applicable
32 to 18 calendar days prior to rental date: 50% of the daily rental charge plus one-way fee if applicable
17 to 0 calendar days prior to rental date:100% of the daily rental charge plus one-way fee if applicable
Travel insurance
We strongly recommend that clients ensure they take out the highest level of travel insurance. In many cases this will cover any losses incurred if you are forced to cancel your booking.
Changes of Bookings
One free change per booking, US$50.00 per change thereafter.
Taxes
Taxes are included for all pre-booked items. Local taxes apply to all pick-up- & drop off charges.
General Information
Clients cannot pick up the vehicle the day they arrive from overseas. We recommend that the customers spend the first night at an airport hotel or motel.
Transfers
Please complete the "Road Bear Speed Pass" to expedite the vehicle pick up procedure. A link to this web based form will be sent to you in your booking confirmation. In this system you will be able to give Roadbear all of your preferred pick up / shuttle transfer information. You will need to have your Road Bear booking number to log in with. This will be sent to you in your boking confirmation email with all other booking details. Please note: you can only enter the data 48 or more hours after the initial reservation was put in our system or a minimum of 4 days prior to vehicle pick-up Further to filling in the Road Bear speed pass all clients must call the rental station upon arrival or the latest at the pick up day between 08:00 am and 10:00 am to schedule the transfer time and place. Transfers are provided to (but not from) the international airports LAX, SFO/OAK/LAS/DEN/EWR (not to/from JFK or La Guardia) and/or airport hotels at all rental locations. In San Francisco/Denver clients will be picked up in downtown and in Los Angeles from Marina del Rey, Venice, Santa Monica for an extra charge of US$35.00 per trip. Transfers will be provided from Monday to Saturday between 11:00 am and 1:00 pm the latest. There will be no transfers after 1:00 pm. The complimentary permitted amount of luggage is in accordance with the airline regulations (2 suitcases@50 pds/23kg plus 2 pieces of hand luggage per person). Excessive luggage is the customer's responsibility.
Pick up and return
Vehicle pick up time is between 12:00 noon and 4:00 pm. Vehicle return time is between 8.00 am and 10:30 am. A charge of US$30.00/hour applied for a late vehicle return. Clients will not be entitled to get a complimentary transfer after 11 am.
Hours of operation
Monday through Friday from 8:00 am to 5:00 pm, Saturday from 8.00 am to 1:00 pm (or during season as required). All stations are closed on Sundays and on all statutory holidays. Denver branch closed from December 1st till February 28th

Driver's license and age
A valid national driver's license is required for each driver. In addition we recommend that foreign customers have an international driver's license or an English translation of the license issued by their home country. All drivers must be at least 21 years of age.
Customer orientation
Staff speaks German & English at all locations - Dutch, French & Italian at some locations. After completing the paperwork the clients get a very thorough personal walk through of the recreational vehicle. In case of an emergency, accident of technical problems, clients may call the emergency toll free number 24-hours a day, 7 days a week.
Gasoline, propane and oil
The cost of gasoline, oil and propane is not included and ROAD BEAR RV does not assume responsibility for estimates of consumption. All vehicles are delivered with full tanks and the customer is expected to return the vehicle with full tanks or will be charges accordingly. If you do not return the vehicle with a full tank of fuel we will refuel the vehicle and pass on the cost of refueling to you. There will be a minimum refueling charge of $20 in the event of the vehicle needing to be refueled by us.
Maintenance
The customer is responsible for checking engine oil and coolant levels at each refueling as well as reporting mechanical failures immediately. Coolant refills and authorized repairs will be reimbursed upon return of the vehicle and presentation of all receipts (see mechanical breakdown). It is the driver's responsibility to operate the vehicle in a safe manner and to exercise all caution possible.
Mechanical breakdown
For maintenance & repairs exceeding US$50.00 the customer must call the ROAD BEAR RV 24-hour toll free telephone assistance to get an authorization. Non-authorized repairs over US$50.00 will not be reimbursed. Receipts must be presented for reimbursement. Customer will be held responsible for mechanical damage due to negligence in operation and/or maintenance.
In the event of an accident
* The customer must obtain a local police report as provided by the attending police officer investigating the accident. An accident report form is supplied to the customer and is located in the vehicle along with the registration- & insurance papers.
* ROAD BEAR RV must be notified as soon as possible. A full-written report along with the other party's name, address, phone number and driver's license number on the supplied accident report form will be required upon return of the vehicle.
* All documents relating to the accident must include a police report- or identifying number.
* Insurance coverage may be void if the above instructions are not followed.
Unauthorized extension of the rental period
Should a customer keep the vehicle beyond the contracted period US$ 30.00 per hour or US$ 300.00 per day penalty fee in addition to the daily rate will apply. However, if the customer contacts ROAD BEAR RV and obtains the proper authorization to extend, the regular rental rate will apply.
Cleaning fee
The clients are responsible to return the vehicle with the interior cleaned and holding tanks dumped. The vehicle outside does not require cleaning by the customer. Cleaning- and/or dumping charges will apply as posted at the drop off location.
Parking/traffic violations
It is the clients responsibility to report and pay for all parking/traffic violations at check-in. Failing to report these violations at drop off will cause a charge of an administrative fee of $ 100.00 plus the fine ( including all late charges) to the clients credit card.
Storage
We provide free storage of luggage at the rental station at client's own risk.
Substitution
If for any reason the booked vehicle should not be available, ROAD BEAR RV reserves the right to substitute a higher-rated vehicle at no additional cost. Should a lower-rated vehicle be substituted, the liability is limited to the refund of the gross rate difference of the two vehicles.
Restrictions
Pets: Pets are not allowed.
Smoking: Smoking is not allowed in any vehicle. US$ 250.00 cleaning/deodorizing fee applies.
Mexico: Traveling into Mexico is not permitted.
Death Valley: Traveling into Death Valley is not permitted between June 15th and September 15th
Alaska: Traveling within Alaska, Yukon and/or NWT is permitted. ROAD BEAR must be advised at the time of reservation
Other: Private-, gravel-, dirt- or logging roads and other non-public roads, beaches, etc. Inner city of New York/Montreal & Quebec City (Canada)
ROAD BEAR RV will hold the customer responsible for accidents or mechanical breakdowns occurring in a travel restricted area!
VIP-Insurance
Included in the daily rate are:
* Public liability insurance to cover accidents in the event that the renter is at fault. The policy protects the company for US$ 1,000,000 and the renter to statutory limits.
* A US$ 1000.00 deductible for accidental damage: "accident damage" includes but is not limited to: (i) motor vehicle accident; (ii) vehicle theft; (iii) vandalism; (iv) fire; (v) windshield & glass damage, etc.
* If renter's motor home vacation is interrupted by an automotive mechanical breakdown for more than 12 working hours after reporting such to ROAD BEAR RV, the renter will be reimbursed for the greater of: i) the gross daily rate or: ii) expenses for hotel rooms up to US$ 25.00 per person per night and car rental up to US$ 50.00 per day per motor home to a maximum of US$ 1500.00 per tour. Receipts for all incurred expenses must be presented for refund. Radio, TV/VCR/DVD, generator, air condition, fridge, cruise control, awning, slide-out & automatic entry step malfunction, etc. are not considered to be mechanical breakdowns.
* Negligent Damage
US$ 3000.00 responsibility for negligent damage: "negligent damage" refers to accidents caused as a result of driver's negligence and includes but is not limited to ; (i) accidents occurring off road; (ii) accidents occurring while backing up; (iii) damage above windshield caused by striking overhead objects, undercarriage damage (including tires and wheels); all damages caused by misuse of slide-out and awnings; (iv) damage caused by freezing of the vehicles systems (when temperatures are below freezing, it is not permitted to fill the water tanks)
The following losses are not covered if damage is caused by:
* Deliberate or wilful damage caused by renter of guests
* Personal contents are not covered
* Failure to maintain all fluid levels
* Driving under the influence of alcohol or drugs
* Traveling in restricted areas
* Carrying more passengers than having seat belts available
* Failure to use specified fuel
* Operation by anyone under 21 years of age
Additional liability coverage can be purchased as described below:
SLI SLI provides the customer with an increased limit of liability protection up to one million dollars
Please take note:
In case of a claim, Road Bear RV will not act as an adjuster for any third party insurances purchased by
the renter (such as $ 0.00 deductible insurance, etc.).
Insurance conditions*
Public Liability Insurance (included in the daily rate)
Public Liability Insurance to cover accidents in the event that the renter is at fault. They policy protects the rental company up to US$ 1,000,000 and the renter to Statutory Limits (State mandated minimum liability coverage).
SLI (Supplemental Liability Insurance)
The optional SLI coverage provides the customer with an increased limit of liability protection. SLI protects the renter and any authorized driver listed on the rental contract for up to US$ 1,000,000 toward 3rd party damage claims.
VIP Coverage (included in the daily rate)
VIP includes secondary comprehensive and collision coverage for the rented vehicle with a deductible of US$ 1000.00 per incident.
Coverage includes but is not limited to:
* Accidental damages to the vehicle (renter's or 3rd party's fault).
* Uninsured Motorist" in case the renter is involved in an accident with a non-insured driver.
* Windshield & glass damage
* Vehicle theft and fire (personal property and items in the vehicle are always excluded)
* Vandalism
The renter's responsibility for negligence and/or non-covered damages e.g. roof damages and roof accessories (all damages above the windshield) is unlimited, up to the vehicle value.
Security Deposit
US$ 1000.00 (authorized on major credit card)
Non-Covered Damages
Customer has full financial and legal responsibility in case of:
* Renters negligence
* Breach or violation of the rental contract
* Accidents outside of public roadways or while backing-up
* Damages to the interior of the vehicle
* Damages to tires, rims, axles and chassis
* Damages to the awning and "slide-out" room
* Damages to the roof or roof accessories (above windshield)
* Damages caused by freezing or overheating of systems
* Deliberate and wilful damage caused by the renter of his guests
* Damages caused to the vehicle by abuse or misusage for illegal activities.
* Damages caused by neglecting proper operating procedures, e.g. incorrect fuel type & quality, ignoring oil or coolant levels etc.
* Damages caused during travel in restricted areas.
* Damages or accidents caused by overloading the vehicle or exceeding the legal towing capacity
* Damages or injuries caused by exceeding the legal passenger carrying capacity.
No insurance coverage is provided (liability or comprehensive & collision) while traveling into non-authorized areas e.g. Mexico
VIP-Vacation Interruption Protection
Should the renter's motor home vacation be interrupted by an automotive mechanical breakdown (not accident or damages caused by the renter) for more than 12 working hours after reporting such to Road Bear RV, the renter will be reimbursed for the greater of the gross daily rental rate or expenses for hotel rooms up to US$ 25.00 per person per night and car rental up to US$ 50.00 per day per motorhome with a combined maximum of US$ 1500.00 per tour.
Defects and repairs on radio, cassette player, TV,VCR, DVD, generator, AC, refrigerator, heater, water heater, slide-out room, awning, cruise control etc. are not considered mechanical breakdowns and excluded from VIP reimbursement. Refund of expenses only possible against proper receipts.
Extra information and Additional charges
Mileage rate
Mileage can be paid for at time of drop off at US$ 0.35 per mile
OR
You can pre-pay for mileage online in 500 mile packages at US$ 170.00 per 500 mile package. Please note there is no refund for unused miles and these mileage packages can only be pre-paid on line. So if you know you are going to travel roughly 1200 miles you are best to purchase two pre-paid 500 mile packages online and pay for the retaining miles directly to Road Bear RV at the end of your rental.
Convenience-Kit (CK)
US$ 65.00 per person; max. US$ 260.00 per vehicle (children up to 6 years free)
The convenience-kit includes: comforter, cover for comforter, sheet, pillow, pillow protector, pillow case bath towel, hand towel, wash cloth, kitchen towel, cleaning towel, paper towel roll, broom, dust pan and brush, bucket/trash can, cloth hangers, flash light, lighter/matches, glass, cup, dinner plate, salad plate, mixing bowl, knife, fork, spoon, teaspoon, roast slicer, cookware set, can opener, cork puller, bottle opener, vegetable peeler, turner, basting spoon, slotted spoon ladle, grill fork, whisk, percolator/coffee maker, measuring cup, colander, cutting board, plastic containers, toaster.

Liability

When you pick up your vehicle, you will be required to sign a rental agreement with the supplier of the vehicle. Your rental and use of the vehicle will be governed by the terms of the rental agreement and any other documentation or information provided to you by the supplier at the time you pick up your vehicle. The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier’s rental agreement or any other documentation provided to you by the supplier at the time of pick up.
While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vehicle. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.
Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.
Booking information
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed. Please note that a 1.75% credit card charge will be added when your payment is processed.
A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.
If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.
Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.
Amendments
Please note that some suppliers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the supplier. In addition to the alteration policy of the supplier stated in their terms, the following charges will apply:
Car rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 25.00
To add or remove extras to/from a confirmed booking: 10.00
Motorhome rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 75.00
To add or remove extras to/from confirmed booking: 20.00
The alteration fee will not be charged if your alteration request is not possible.
Vehicle Capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.

Our shuttle service picks up from the Airport area and Downtown hotels listed below. You do not need to stay in these hotels but must be present at these hotels for complimentary shuttle pick up before 11am.
